Acceptance of Terms
By accessing or using services or content provided by Cooper Creek Notary ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our website, mobile applications, services, or communications (collectively, the "Services").
Scope of Services
Cooper Creek Notary provides notary and notarial-related services, document preparation assistance limited to administrative and clerical tasks, scheduling, information about notarial procedures, and related customer support.
No Legal Advice; Not Attorneys
Cooper Creek Notary is not a law firm. We are not licensed attorneys and do not provide legal advice, legal representation, or attorney services. Information, templates, forms, guidance, or communications provided through our Services are for general informational and administrative purposes only and should not be relied upon as a substitute for professional legal advice. If you need legal advice, you should consult a licensed attorney in your jurisdiction.
User Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.
User Responsibilities
Provide accurate, complete, and current information when using our Services.
Comply with all applicable laws, regulations, and rules governing your use of our Services.
Use our Services only for lawful, non-fraudulent purposes.
Ensure any documents you submit are complete and truthful. We are not responsible for the accuracy or legality of information you provide.
Appointment, Cancellations, and Fees
Appointments: Appointments requested through our Services are subject to availability. We will confirm appointment details by email, phone, or other means.
Fees: Fees for notary and related services will be disclosed before service is rendered. You are responsible for paying fees and any applicable taxes. We reserve the right to change fees; changes will not affect fees for services already scheduled and accepted unless otherwise disclosed.
Cancellations/Rescheduling: Our cancellation and rescheduling policies will be provided at the time of booking. Failure to appear for a scheduled appointment may result in forfeiture of any fees paid and additional charges.
Payment and Refunds: We accept payment methods disclosed on our Services. All payments are due as specified. Refunds may be issued at our discretion in accordance with applicable policy. If a refund is issued, any payment processing or administrative fees previously collected may be deducted.
Electronic Signatures and Remote Notarization
Where offered, remote online notarization (RON) or electronic notarization options will be provided in accordance with applicable state law. Consent to use electronic signatures is required where RON is offered. Availability of remote services varies by jurisdiction and document type. It is your responsibility to confirm that remote notarization is legally valid for your document and use.
Privacy
Our collection and use of personal information is governed by our Privacy Policy. By using the Services, you consent to the collection, use, and disclosure of your information as described in that policy.
Intellectual Property
All content, trademarks, logos, graphics, and materials provided by Cooper Creek Notary are owned by or licensed to us and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit our content without prior written consent except as necessary to use the Services for their intended purpose.
Prohibited Conduct
You agree not to:
Engage in illegal, fraudulent, or harmful activities using our Services.
Misrepresent your identity or authority to sign documents.
Interfere with or disrupt the integrity or performance of the Services.
Use automated means to access the Services except as expressly permitted.
Disclaimers; No Warranty
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
COOPER CREEK NOTARY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.
IF YOU RELY ON INFORMATION OR DOCUMENTS PROVIDED THROUGH THE SERVICES, YOU DO SO AT YOUR OWN RISK.
Disclosures & Limitation of Liability
I AM NOT AN ATTORNEY LICENSED TO PRACTICE LAW IN WISCONSIN AND MAY NOT GIVE LEGAL ADVICE OR ACCEPT FEES FOR LEGAL ADVICE.
Cooper Creek Notary provides professional notary services but does not own, operate, or control the secure third-party platforms used to facilitate Remote Online Notarization (RON). By using this service, you acknowledge and agree to the following:
Platform Performance: Kaitlyn Ford and Cooper Creek Notary are not liable for any technical issues, system outages, or data breaches occurring on the third-party notarization platform.
No Legal Advice: As a commissioned notary, I am legally prohibited from providing legal advice, drafting documents, or explaining the legal effects of your paperwork. Any information provided is for administrative purposes only.
Document Validity: My role is to verify identity and witness signatures. I am not responsible for the underlying legality, accuracy, or enforceability of the documents being notarized.
User Responsibility: I am not liable for delays caused by a client’s lack of proper identification, incompatible hardware (camera/microphone), or unstable internet connection.
Maximum Liability: To the fullest extent permitted by law, Cooper Creek Notary and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages. In no event shall the aggregate liability for all claims relating to the services exceed the total amount paid by you for the specific notary service giving rise to the claim.
